Probate/Estate Administration
|
When someone dies, what happens to his or her assets, how title and ownership are transferred, how debts are paid, how assets are distributed to the rightful parties, and who takes care of looking out for assets that pass to minor children can seem confusing and even overwhelming. Unfortunately, a significant amount of incorrect information is often circulated about the administration and settlement of decedents' estates formally known as the "probate process."
Undeniably, the administration of the estate of a deceased individual can be complicated by various factors such as the nature and status of assets, lack of cooperation between heirs or beneficiaries, or excess debts held by the decedent, and it can take some time to finalize the financial affairs of a decedent. However, probate proceedings can run smoothly and efficiently, and it is our firm's goal to expedite the administration process so as to allow the decedent's assets to be distributed to the rightful heirs or beneficiaries whout undue delay. We seek to work closely with and assist the decedent's Personal Representative (known as the Executor or Administrator) with his or her duties and to provide guidance and recommendations based on our years of experience in this field.
Typical services our firm provides in connection with the administration of a decedent's estate are:
- Beginning the probate process by opening the Estate through the Register of Wills Office
- Determining the Nature and extent of the decedent's assets
- Collecting assets and applying them to proper payment of the decedent's debts and expenses, including claims of creditors
- Preparation and filing of the Inventory of the decedent's assets to the rightful parties without need for Court pre-approval or, alternatively when the situation warrants, submission of documents to Court to obtain a Court Decree directing the distribution of assets
